Terms And Conditions
- I hereby confirm that I have completed 18 years of age on the date of submitting my application to the Company for consideration. Upon acceptance of my application by the Company, I may be designated as a Member/Subscriber/Customer/Executive or Distributor of the Company for the purpose of selling the tour services. I agree to abide by the Terms and Conditions set forth by the Company, a copy of which has been provided to me. I further declare that I have read and fully understood these Terms and Conditions prior to submitting my application.
- It shall be your sole responsibility to accurately complete and submit all KYC details required by the Company for application processing and payment-related purposes.
- Power Star Holidays, assure you that all personal details provided and received by the company, including PAN number, Aadhaar card, signature, and any other sensitive information, will be handled with the utmost confidentiality and will not be misused under any circumstances.
- I undertake not to refer or introduce any tour services which are not promoted or provided by the Company.
- Except for the specific responsibilities formally assigned to me, I shall not represent or act as an authorized representative, agent, or employee of the Company in any transaction. I acknowledge that I possess no express, implied, or ostensible authority to act on behalf of the Company unless and until I am formally recognized as such.
- It shall be sole discretion of the Company to deal with its own business by laying down necessary Rules/Regulations/Policies and Procedures from the time to time and I shall abide by the same.
- The agreement shall be governed by the laws of the country and all claims and disputes and other matters between parties of this agreement shall be brought to the appropriate court of law (Bengaluru jurisdiction).
- For all the purpose, only English and kannada version will be taken as the official copy.
- The Company operates in compliance with the Consumer Protection (Direct Selling) Rules, 2021, issued by the Government of India.
- No printed material by Member/Customer/Executive/Distributor is allowed to be circulated without the written permission of the Company, otherwise Member/Customer/Executive/Distributor could be terminated.
- The Company shall deduct service charges from the incentives (Received for selling tour service) and I authorise the Company to deduct service charges for any payments made to me by the company.
- Any Business Associate found guilty for spreading any sort of misleading information can be terminated at the discretion of the Company.
- The Company shall not be held liable for any actions, representations, or conduct of its members, executives, customers, or distributors that fall outside the scope of the Company’s officially specified policies, guidelines, or applicable laws and regulations.
- The Company shall not be liable for any incidental or consequential damages, damages caused by breach, cancellation or suspension of this agreement, whether or not the possible reasons for such damages is known to the Company.
- The Company shall not be held responsible for any accidental casualties, loss, theft, or damage to personal belongings occurring during the course of the tour services.
- Any Member/Customer/Executive/Distributor involving in any activities against the aims/objectives. Rules & Regulations of the Company such person would be removed without notice and appropriate action would be initiated against him as per the court of law.
- Any Member/Customer/Executive/Distributor shall not be construed as the permanent employee of the Company.
- All the payment/acceptance shall be made to/from the Company's Bank Account (Power Star Holidays) and members will receive an SMS confirmation to the registered mobile number, and the receipt can be downloaded.
- Company shall not be responsible for payment made for any person( Other than Power Star Holidays). In case any cash as to be deposited same shall be deposited to the company bank account and necessary receipt shall be obtained.
- The Company does not assure any rewards/incentives merely on account of becoming members/customer/executive/Distributor to the Company.They shall be eligible for any reward/incentive directly proportionate to the individual performance, effort in selling company tour service, made by such person subject to the eligibility norms formulated by the Company from time to time.
- I shall be liable to pay necessary service charges for any tour package opted by me as per the terms and conditions which I have read and understood.
- I shall be solely liable to pay all applicable taxes, including Goods and Services Tax (GST), on any rewards, incentives, or products received by me from the Company.
- The Company will approve the Member/ Customer/Executive/Distributor by issuing an official application and an receipt through online, which will carry the identification number know as TrackID, as chosen by the Company.
- The TrackID have to be quoted by the member/executive/customer/Distributor in all his/her transactions and correspondence with the company. The track ID once chosen cannot be altered at any point of time.
- All individual Member/Customer/Executive/Distributor should adhere to the rules and regulations formed by the organisation and if any of the Member/Customer/Executive/Distributor is guilty of not observing the same, then he/she shall be liable to be terminated from the same. The company reserves all rights to terminate a Member/Customer/Executive/Distributor for non-compliance of any company rules, regulations and guidelines.
- The Member/Customer/Executive/Distributor shall always behave and act in the dignified manner befitting the status of a Member/Customer/Executive/Distributor of a reputed and leading establishment of the country.
- Tour packages may not be assured during seasonal holidays like Christmas holidays, New year celebration etc.The tour will be sent 30 days after confirmation and only registered customers or their family members are eligible to use the tour packages.
- Refunds, if any, shall be governed by the Company's refund policy, subject to applicable laws. Tour advance payments are generally non-refundable, except under special cases decided solely by the Company within 48 hours of payment.
- Flight, train, and other travel charges (if not specifically mentioned) are not included in the tour package.
- This agreement constitutes the entire agreement between myself and Power Star Holidays and no other promises, representation, guarantees or agreements of any kind shall be valid unless given in writing. Jurisdiction in respect of any and all dispute arising out of or in relation to this agreement shall Vest exclusively in the courts of Bengaluru Jurisdiction.
